Privacy Policy
Lawyer Trust and its affiliates (including Disputelab.com, eConsumer Services and Global Risk Technologies) have adopted this Privacy Policy (the “Policy”) to establish and maintain an appropriate level of privacy protection for Personal Information consistent with the obligations set forth in the Privacy Policy. Shield frame. This Policy applies to the processing of Personal Data that Lawyer Trust receives from Clients located in the European Union and Switzerland.
Lawyer Trust complies with EU-US law. Privacy Shield Framework and agreement between Switzerland and the United States. Privacy Shield Framework ("Privacy Shield") established by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and the United Kingdom and/or Switzerland applicable to the United States in reliance on Privacy Shield. Lawyer Trust has confirmed to the Department of Commerce that it adheres to the Privacy Shield principles with respect to such information. In the event of a conflict between the terms of this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall prevail. All Lawyer Trust employees who process personal data from Europe are required to comply with the principles set out in this Policy.
1 AREA OF USE
This Policy applies to the processing of Client Personal Data and/or Human Resources Data that Lawyer Trust receives in the United States in relation to Lawyer Trust Client Data and/or Human Resources Data in the EU. This Policy applies to all of our U.S. entities, subsidiaries and/or affiliates (listed below in the “Other Covered Entities” section).
2. RESPONSIBILITY AND MANAGEMENT
Lawyer Trust has assigned its legal department to oversee its information security program, including compliance with the Privacy Shield program. The Legal Department reviews and approves any significant changes to this program as necessary. Any questions, concerns or comments regarding this Policy can also be directed to info@lawyertrust.info.
Lawyer Trust will maintain, monitor, test and update information security policies, practices and systems to help protect the Personal Data it collects. Lawyer Trust staff will receive appropriate training to effectively apply this Policy. Please refer to Section 6 for a discussion of the steps Lawyer Trust has taken to protect Personal Data.
3. RENEWAL/CHECK
Lawyer Trust will renew its Privacy Shield certification annually unless it is subsequently determined that such certification is no longer required or it utilizes another adequacy mechanism. Prior to recertification, Lawyer Trust will conduct an internal review to ensure that its certifications and representations regarding the processing of Customer Personal Data are accurate and that it has properly implemented these practices. Specifically, as part of the verification process, Lawyer Trust agrees to do the following:
3.1 Review this Privacy Shield policy and the website's publicly available privacy policy to ensure that these policies accurately describe how Personal Data is collected from Clients;
3.2 Ensure that the publicly available privacy policy informs Clients about Lawyer Trust's participation in the Privacy Shield program and where to obtain a copy of additional information (e.g., a copy of this Policy);
3.3 Ensure that this Policy continues to be consistent with Privacy Shield principles;
3.4 Confirm that Clients are familiar with the complaints process and any independent dispute resolution process (Lawyer Trust may do this through its publicly accessible website, client contract, or both);
3.5 Revise its processes and procedures to train Employees on Lawyer Trust's participation in the Privacy Shield program and the proper handling of Client Personal Data.
4. PERSONAL DATA COLLECTION AND USE
Lawyer Trust provides various solutions to its customers, who are primarily business customers, and collects certain personal data from customers when they purchase our services, log into their account, request information from Lawyer Trust, or otherwise communicate with Lawyer Trust. For example, Lawyer Trust customers can call for real-time support or request transaction data related to a chargeback or a related customer to a transaction in which a chargeback occurred.
The personal data that Lawyer Trust collects may vary depending on the Clients and their specific request for services. Generally, Lawyer Trust may collect the following types of Personal Information from its Clients: contact information, including contact person's name, work email address, work mailing address, work phone number, job title and company name, and as payment information (which may include credit card and/or bank account information). Clients have the option to log into their accounts online, and Lawyer Trust will collect information that Clients choose to provide to Lawyer Trust through these portals.
Lawyer Trust acts as a service provider for its clients. As a service provider, Lawyer Trust will receive, store and/or process Personal Data owned and/or controlled by our Clients, including information about their employees, clients, clients, agents or other persons. In such cases, Lawyer Trust acts as a data processor and will process personal information on behalf of and under the direction of each Client. Information received from Lawyer Trust Clients in this capacity is used for transaction management, reporting, billing, renewals, other operations related to the provision of services to the Client, as well as at the Client’s request.
5. DISCLOSURE / FURTHER TRANSMISSION OF PERSONAL DATA
Unless otherwise provided herein, Lawyer Trust will only disclose Personal Data to a third party who has a reasonable need to know such data. Such recipients must agree to observe confidentiality obligations. Lawyer Trust provides, upon request, Mutual Non-Disclosure Agreements for its clients, which may be tailored to the client’s individual business needs, as a means of controlling and limiting the disclosure of client’s personal information.
Lawyer Trust may share Personal Data with Third Parties who act as agents, consultants and contractors to perform tasks on behalf of and under our instructions. For example, Lawyer Trust may store such Personal Data at facilities operated by a third party. Such third party must consent to the use of such Personal Data only for the purposes for which it has been engaged under the LAWYERTRUST Family Law, and it must either: (1) comply with the Privacy Shield principles or other mechanism permitted under applicable European data protection law ( s) for the transfer and processing of Personal Data; or (2) agree to provide appropriate protections for Personal Data that are no less protective than those set forth in this Policy. Lawyer Trust may also disclose Personal Data for other purposes or to another Third Party where the Data Subject has consented to or requested such disclosure. In case of further transfer of data to third parties E.U. or Swiss nationals obtained under the EU-US Agreement. Privacy Shield and Swiss-U.S. Privacy Shield, Lawyer Trust bears potential liability.
6. DATA INTEGRITY AND SECURITY
Lawyer Trust uses reasonable efforts to maintain the accuracy and integrity of Personal Data and to update it as necessary. Lawyer Trust has implemented physical and technical safeguards to protect Personal Data from loss, misuse and unauthorized access, disclosure, alteration or destruction. For example, electronically stored personal information is stored on a secure network with firewall protection, and access to Lawyer Trust's electronic information systems requires user authentication by password or similar means. Lawyer Trust also enforces access restrictions, limiting the number of Employees who have access to Clients' Personal Data. In addition, Lawyer Trust utilizes secure encryption technology to protect certain categories of personal data. Despite these precautions, no data protection measures can guarantee absolute security at all times and therefore Lawyer Trust makes no such guarantees.

Lawyer Trust notifies Customers of its compliance with the Privacy Shield principles through its publicly available privacy policy on its website
8. ACCESS TO PERSONAL DATA
Lawyer Trust employees may access and use Personal Data only if they are authorized to do so and only for the purpose for which they are authorized.
9. RIGHT TO ACCESS, CHANGE OR DELETE PERSONAL DATA
9.1 Right of Access. Data subjects have the right to know what Personal Data about them is included in the databases and to ensure that such Personal Data is accurate and up to date for the purposes for which Lawyer Trust
collected the Personal Data. Data subjects may review their own Personal Data stored in databases and correct, erase or block any incorrect data in accordance with applicable law. Upon reasonable request and as required
In accordance with the Privacy Shield Principles, Lawyer Trust provides Clients with access to their Personal Data in order to correct or amend such data if it is incorrect. Clients can edit their Personal Data by contacting Lawyer Trust by telephone or email. When making changes to their Personal Data, Data Subjects must provide only true, complete and accurate information. To request deletion of Personal Data, Customers must submit a written request. Individuals who have submitted
their Personal Data Lawyer Trust Client should first contact the Client to update their details.
9.2 Personal Data Requests. Lawyer Trust monitors each of the following events and notifies the appropriate legal and contractual parties when any of the following circumstances occur: (a) a legally binding
request for disclosure of Personal Data by a law enforcement agency unless prohibited by law or regulation; or (b) requests received from the Data Subject.If Lawyer Trust receives a request to access his/her Personal Data
from a client of a Client, then unless otherwise required by law or under an agreement with such Client, Lawyer Trust will transfer such Data Subject to the Client.
9.3 Accommodating requests for access, modifications, and corrections. Lawyer Trust will endeavor to respond in a timely manner to all reasonable written requests to review, change, or deactivate Personal Data.
10. CHANGES TO THIS POLICY
This Policy may be amended from time to time in accordance with the Privacy Shield Principles and applicable data protection and privacy laws and principles. Lawyer Trust will keep Employees informed of changes to this policy and will notify Clients if any changes are made that materially affect the way in which Personal Data is processed and previously collected, and Lawyer Trust will allow Clients to choose whether their Personal Data may be used in any way in significantly different ways.

12. APPLICATION AND DISPUTE RESOLUTION

We will investigate and attempt to resolve any complaints or disputes regarding the use or disclosure of your EU Personal Data within 45 days of receiving your request or complaint. If you do not receive timely acknowledgment of your complaint from us, or if we have not adequately addressed your complaint, please visit your country's DPA for more information or to file a complaint.
Lawyer Trust has also committed to referring unresolved privacy complaints to the relevant EU authorities Data Protection Authority (DPA) and/or the Swiss Federal Data Protection and Information Commissioner (FDPIC). The services of the EU Data Protection Authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) are provided to you free of charge.
Under certain conditions, described in more detail on the Privacy Shield website, you may initiate binding arbitration when your options have been exhausted. other dispute resolution procedures.
13. Definitions
Capitalized terms in this Policy have the following meanings:
“Customer”means a potential, current or former partner (distributor or reseller), seller , supplier, client or Lawyer Trust client. This term also includes any individual agent, employee, representative, client,
or client of a Lawyer Trust Client if Lawyer Trust has received his or her Personal Data from such Client as part of its business relationship with the Client.
“Data subject” means an identified or identifiable living natural person. An identifiable person is a person who can be identified directly or indirectly by name or by one or more factors unique to his or her identity.
personal physical, psychological, mental, economic, cultural or social characteristics. For Customers residing in Switzerland, Data Subject may also include a legal entity.
Employeemeans an employee (whether temporary, permanent, part-time or contract), former employee, independent contractor or a job applicant of Lawyer Trust or any of its branches or subsidiaries who is also a resident of
a country within the European Economic Area.
“Europe”or “European” refers to the country in the European Economic Area.
“Personal Data”as defined in European Union Directive 95/46/EC means data that identifies or can be used to personally identify an individual, including the name of an individual in combined with country of birth,
marital status, emergency contact, salary information, terms of employment, job qualifications (such as educational degrees obtained), address, telephone number, email address, user ID, password and identification numbers. Personal data does not
include de-identified, anonymous or publicly available data.For Switzerland, the term "person" includes both natural and legal persons, regardless of the form of legal entity.
"Third party"means any natural or legal person who is neither an employee, agent, contractor or representative of Lawyer Trust, nor an employee, agent, contractor or representative of Lawyer Trust.
